1. Agreement

By purchasing services, custom development work, or any digital products ("Services") from marpal.dev ("we", "us", "our"), you ("the Client") agree to these Terms of Service. If you do not agree, please do not use our Services.

2. Scope of services

We provide PHP and web development services including but not limited to:

Specific deliverables, scope, and timelines are agreed in writing for each engagement (via email or a written quote).

3. Pricing and payment

Hourly and bundle rates are listed on our pricing page. Custom projects are quoted individually after scope discussion. Payment is required in advance for all hourly and bundle purchases. For larger projects, milestone-based payments may be agreed in writing.

Payments are processed securely through Stripe and PayPal. We do not store credit card or banking information on our servers — all sensitive payment data is handled directly by our payment processors.

All prices are in US Dollars unless otherwise stated. Applicable taxes may be added depending on your jurisdiction.

4. Delivery and timelines

We aim to respond to new inquiries within 24 hours. Hourly work is scheduled by mutual agreement after payment is received. Custom project timelines are estimated in writing before work begins. While we make every effort to meet agreed deadlines, exact delivery times depend on project complexity, client responsiveness, and access to required systems and credentials.

Hourly and bundle credits are refundable in full if no work has been started. Once work has begun, refunds are prorated based on hours already used. Completed custom development work is non-refundable, but we will make reasonable efforts to address bugs or issues in delivered code within 14 days of delivery at no additional cost.

Refund requests should be sent by email. We typically respond within 2 business days.

7. Intellectual property

Upon full payment, custom code written specifically for the Client becomes their property and may be used, modified, and redistributed as they see fit. We retain the right to reuse general techniques, patterns, and non-Client-specific code components in future projects.

Third-party libraries, frameworks, and pre-existing code included in deliverables remain subject to their original licenses.

8. Confidentiality

We treat all Client information, credentials, source code, and business details as confidential. We will not share, sell, or disclose this information to third parties except where required by law. Access credentials provided to us are deleted from our systems within 30 days of project completion unless the Client requests ongoing maintenance.

9. Warranties and limitations

We provide services on an "as is" basis and warrant only that work will be performed with reasonable skill and care. We do not warrant that delivered code will be entirely error-free or compatible with all possible server configurations or third-party software.

Our total liability for any claim arising from Services is limited to the total amount paid by the Client for the specific Service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages including loss of profits, data, or business opportunities.

10. Prohibited use

We reserve the right to decline or terminate any engagement that involves illegal activity, infringement of intellectual property, violation of applicable laws or regulations, or any activity that violates the terms of our payment processors.

11. Termination

Either party may terminate an engagement with written notice. If the Client terminates, they remain responsible for payment for all work performed up to the date of termination. Unused bundle hours expire 30 days after purchase unless otherwise agreed in writing.

12. Changes to these terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of our Services after changes constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which marpal.dev operates. Any disputes will first be addressed through good-faith discussion, and if unresolved, through the appropriate courts of that jurisdiction.
